Competition ServicesKPMG Forensic has a dedicated team of experienced competition professionals. We can provide robust, commercial and practical advice on a wide range of competition issues, such as:

 

Mergers

  • Where a competition authority’s investigation of a merger raises serious concerns requiring parties to give undertakings, we can act as Independent Trustee to monitor them.
  • We can help steer parties through the practicalities of implementing undertakings, gaining the confidence of the competition authorities while limiting business disruption.

Investigations

  • With greatly increased investigatory powers, competition authorities are conducting many more investigations. We are able to help clients respond to dawn raids and investigations.
  • Working with lawyers and economists, we can use forensic technology to capture evidence quickly, advise on tactics and help prepare robust factual and financial submissions.

Damages

  • Third parties can bring actions for damages before the Competition Appeal Tribunal (CAT), where they have suffered losses as a result of infringements of competition law.
  • We can help to achieve recoveries for claimants, combining our experience of damages claims in commercial litigation with relevant economic analysis.

State Aid

  • We have experience of working with lawyers to assist clients in connection with EC State Aid matters, in particular under the Market Economy Investor Principle (MEIP) for example, as to whether a proposed injection of funds constitutes State Aid.
